The legal status of foreign investment in Iran has passed many levels. Too strict, limiting laws and laws which were more desirable and finally a professional view to foreign investment are the characteristics of relevant rules. The legislator has paid attention to capital market as a method that has many abilities to absorb foreign capital. Although in the initial legal sources foreign investing in capital market is generally permitted but in the recent laws this aspect is professionally viewed but unfortunately in every period of legislation, a part of capital market and its abilities is forgotten. There are different problems in legal status of foreign investment in capital market such as ambiguity in relevant laws.
However, in the field of foreign investment in general and foreign investment in particular, capital markets research has been done but researches with this type of attitude to the legal aspects of investment and explanation of all rules and regulations in this area is necessary. In this article, has trying legal status evolution with all laws and regulations, and legal aspects of its problem and suitable solution.
